I have cover songs on my album; is that a problem?

Using cover songs is okay if you follow certain steps before making the recording available to the public. The Copyright Act provides the right to what is called a “Compulsory License.” It is imperative that you follow the steps set forth by statute. A Compulsory License is valid only for sales of the CD and downloads that occur in the United States. Once you begin distributing the cover song, it is your responsibility to send the Statutory Royalty to the publisher monthly.
***NOTE*** You may be able to negotiate a better deal for yourself – either in terms, or a lower rate, or a reduced frequency at which to make royalty payments. If you are successful in negotiating terms that are different than the standard Compulsory License, a Mechanical License is issued by the publisher. BILL did I read the first sentence of the note correctly? I added commas that may have changed the meaning. If I changed the meaning, the sentence needs a bit more work.
For expert advice consult with an entertainment attorney.

What if I don’t know who the composer and/or publisher of a song is?

In order to sell your product in our store, you need to know the composer and publisher of every song. Use the following resources:

If you cannot find the publisher because the song is so old it is in the public domain, use “public domain” for the publisher when submitting.
If you cannot find the composer because the song is so old it is in the public domain, use “anonymous” for the composer when submitting.
Music that is not in the public domain cannot be accepted without the composer and publisher information!

How can I register my copyright?

Registration of your copyrighted CD with the U.S. Copyright office provides peace of mind and gives you legal standing if someone does copy your work. You may fill out the forms yourself and submit them to the U.S. Copyright Office or you may select our U.S. Copyright Registration service and we will do it for you. The process takes 6-12 months for Simplie Indie to receive the Certificate of Registration. The process also requires you to supply us with two copies of your CD.

Will my sales be reported to SoundScan?

For now your sales will not be reported to SoundScan. For sales to be reportable to SoundScan, all sales have to be done on a point-of-sale system, which requires all products to have a bar code. Simplie Indie does not require you to submit your CD with a bar code. Simplie Indie is in development of its own recognition system to celebrate the success of independent musicians independent of SoundScan and other traditional industry practices.
